General Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following terms are defined as:

  • Cooling-off period: The period within which the consumer can exercise their right of withdrawal.

  • Consumer: The natural person not acting in the exercise of a profession or business who enters into a distance agreement with the vendor.

  • Right of withdrawal: The possibility for the consumer to cancel the distance agreement within the cooling-off period.

  • Vendor: Ironway, offering products and/or services at a distance to consumers.

  • Distance agreement: An agreement concluded under an organized system for remote sales using one or more techniques for remote communication.

Article 3 – Applicability

These general terms and conditions apply to any offer by the vendor and any distance agreement and orders between the vendor and the consumer. Before the distance agreement is concluded, the text of these terms will be made available to the consumer electronically in a way that they can easily be stored.

Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be explicitly stated. Obvious mistakes or errors in the offer do not bind the vendor. Prices stated in the offer exclude customs clearance fees and import VAT. These additional costs, collected by postal or courier services upon entry into the destination country, are at the consumer's expense.

Article 5 – The Agreement

The agreement is concluded at the moment the consumer accepts the offer and meets the set conditions. The vendor will promptly confirm receipt of electronic acceptance. Each agreement is concluded under the suspensive condition of sufficient product availability.

Article 6 – Right of Withdrawal

Upon purchasing products, the consumer has the option to dissolve the agreement without stating a reason within 14 days. This cooling-off period starts the day after the consumer receives the product. During this time, the consumer must handle the product and packaging with care, only unpacking it to the extent necessary to assess the item.

Article 7 – Costs in the Event of Withdrawal

If the consumer exercises their right of withdrawal, the costs of returning the products are the responsibility of the consumer. The vendor will refund the purchase amount as soon as possible, but no later than 14 days after withdrawal, provided the product has been returned or proof of return is provided.

Article 8 – Exclusion of the Right of Withdrawal

The vendor can exclude the right of withdrawal for specific products, such as those made to consumer specifications, clearly personal items, or hygiene products where the seal has been broken. This exclusion must be clearly stated in the offer.

Article 9 – The Price

During the validity period stated in the offer, prices will not be increased except for changes in VAT rates or statutory regulations. As delivery takes place outside the USA, the courier service will collect import VAT or customs clearance costs from the customer; therefore, no VAT is charged directly by the vendor.

Article 10 – Conformity and Warranty

The vendor guarantees that products comply with the agreement and reasonable requirements of usability. A product will not be considered defective if the issue is a result of improper use or maintenance by the consumer.

Article 11 – Delivery and Execution

The vendor will execute accepted orders with due speed, typically within 30 days unless a different period is agreed. The place of delivery is the address provided by the consumer. The risk of damage or loss rests with the vendor until the moment of delivery to the consumer or a designated representative.

Article 12 – Payment

Unless otherwise agreed, amounts owed by the consumer must be paid immediately after concluding the agreement. The consumer is obligated to notify the vendor of any inaccuracies in provided payment details immediately.

Article 13 – Complaints and Disputes

Complaints about the performance of the agreement must be submitted to the vendor within a reasonable period after the consumer observes the defect. If a complaint cannot be resolved by mutual agreement, the dispute may be submitted to the competent court or the European Commission's online dispute resolution (ODR) platform.

Article 14 – Additional Provisions

Additional or deviating provisions from these terms may not be to the detriment of the consumer and must be recorded in writing or stored in an accessible manner on a durable data carrier.
